NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN IN THIS PROMOTION. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. YOU HAVE NOT YET WON A PRIZE.

ELIGIBILITY: The “Crest Auto Group Car Giveaway” (the “Promotion”) is open only to legal residents of the state of Texas who are at least 21 years of age, with a valid driver’s license, at time of entry. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and to Crest Cadillac II, LLP and Crest Infiniti II, LLP (collectively “Crest”) decisions, which are final and binding in all matters related to the Promotion. Winning a prize is contingent on fulfilling all requirements set forth herein. Crest reserves the right to verify the eligibility of winner. Void outside the state of Texas and where prohibited by law. Subject to all applicable federal, state and local laws, regulations, and ordinances.

INELIGIBLITY: Employees, officers and directors of Crest, any of their parent companies, subsidiaries, affiliates, representatives, franchisees, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment, and marketing agencies, web site providers, web masters, and members of their immediate families (spouses, parents, children, siblings and their spouses, regardless of where they live) and those living in the same household are not eligible to enter or win.

PROMOTION PERIOD: The Promotion begins at 6:00 p.m. Central Standard Time (“CST”) on February 3, 2008, and ends at 9:00 p.m. CST on February 4, 2008 (the “Promotion Period”). The public voting will begin at 12:01 a.m. Central Standard Time (“CST”) on February 8, 2008, and ends at 11:59 p.m. on February 15, 2008.

HOW TO ENTER PROMOTION: To enter the Promotion:

Visit www.CrestCars.com on February 3 or 4, 2008, and follow the directions to register for the Promotion (information that you must submit to register includes first name and last name, phone number, email address;
Visit the Crest Infiniti/Cadillac dealership at 2701 N. Central Expressway, Plano, Texas 75075 on February 4, 2008 before the end of the Promotion Period and test drive a new 2008 Cadillac CTS or 2008 Infiniti G35 automobile; AND
Before the end of the Promotion Period, perform a football touchdown dance or celebration that will be video recorded at the dealership.

Limit: One entry per person, per household. Sponsor is not responsible for lost, damaged, misdirected, illegible or incomplete registrations or other entry materials. Any attempt by any participant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses or any other method will void all of that participant's entries, and that participant may be disqualified at Sponsor’s discretion. Normal Internet access, phone and usage charges imposed by your online or phone service may apply. All entries become the property of Sponsor and will not be returned or acknowledged, and Sponsor will not verify receipt of entries. All entrants agree that Sponsor and Sponsor’s agents, affiliates or service provides may use entrants’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or Promotion that Sponsor thinks may be of interest. Sponsor will not sell personal information submitted with entry to outside solicitors.
Promotion entries will be attributed to the authorized account holder of the email address submitted during registration/entry. In the event of a dispute as to the identity of an entrant, the authorized account holder of the email address used to enter will be deemed to be the registrant or participant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted address. Winning participants may be required to provide Sponsor with proof that the claimed winner is the authorized account holder of the email address associated with the winning entry, or forfeit the prize. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win.

SELECTION AND NOTIFICATION OF WINNER: One (1) winner will be selected from the eligible entrants’ submissions of video-recorded touchdown dances or celebrations. Entries will be judged on the following criteria (“Winner Selection Criteria”): originality (20%), creativity (20%); style (20%); execution (20%); and level of enthusiasm (20%). Sponsor will select the five (5) entrants with the highest score based on his or her video-recorded touchdown dance or celebration, and post the recording of each dance/celebration on www.CrestCars.com. The public will have the opportunity to visit www.CrestCars.com after the recordings are posted and vote for their favorite. The entrant that receives the highest number of votes will be declared the winner. In the event of a tie, Sponsor will select the winner through a random drawing of the entries corresponding to the entrants that have tied for the highest number of votes. Winner will be notified that he or she has won by e-mail, telephone and/or overnight mail within seven (7) days of judging. Except where legally prohibited, potential winner must execute an Affidavit of Eligibility and Liability/Publicity Release form (“Eligibility/Liability Form”) within seven (7) days of notification. Return of any prize or prize notification as undeliverable may result in disqualification and selection of an alternate winner. If a potential winner fails to sign and return the Eligibility/Liability form, or if the potential winner is unavailable to accept the prize within the time period specified, or to use the prize on dates specified by Sponsor, the potential winner will be disqualified and an alternate entrant will be selected. Up to three (3) alternate winner drawings will be held, after which the prize will remain unawarded.

PRIZE: There will be one (1) prize awarded subject to Sponsor’s verification of the Winner. The prize awarded will be a (two) 2-year lease on the winner’s choice of a new 2008 Cadillac CTS (VIN 1G6DM577680125590) OR 2008 Infiniti G35 (VIN JNKBV61E88M206323) (“Vehicle”) on approved credit. Sponsor will pay up to $595 per month towards monthly lease payments for the Cadillac CTS and up to $495 per month towards monthly lease payments for the Infiniti G35. Winner’s credit score must be worthy to qualify for B Tier or above for the Cadillac CTS or Tier 1 or above for the Infiniti G35. If Winner does not qualify for $595 monthly payment for Cadillac CTS or $495 monthly payment for Infiniti G35 monthly payment, Winner will be responsible for the difference in monthly payments. There is no security deposit. If Winner does not qualify for lease due to low credit score and/or poor credit history, Winner will forfeit prize. Vehicle will be delivered with standard equipment and factory options; any additional factory options are at the sole expense of the Winner. Color and other prize specifics to be determined by Sponsor and are subject to availability (as a model year progresses, changes may occur in some of the specifications, features, optional equipment and pricing).

The Promotion winner will be required to sign a Lease Agreement with Sponsor on or before February 29th, Close of Business, but must have lease application submitted by February 18th, Close of Business. The Promotion winner will be required to provide a valid U.S. driver’s license and proof of insurance with a maximum $1,000 /$1,000 deductible or coverage requested by Lender to claim Prize; failure to show same may result in disqualification in Sponsor’s sole discretion.

The prize is not transferable and no substitution is allowed except in Sponsor’s sole discretion. Prize may not be redeemed for cash. Sponsor reserves the right to substitute prize of equal or greater value if advertised prize (or portion of prize) is unavailable. Winner is responsible for any loss of prize or portion of prize after it has been delivered. Sponsor will not replace any lost or stolen prizes. Any and all applicable federal, state and local taxes (including but not limited to income and sales taxes) and all fees and expenses related to acceptance and use of the prize not specifically stated herein are the sole responsibility of winner. All expenses associated with the use of the prize are the sole responsibility of winner. Prize winner will be issued a 1099 tax form for the appropriate retail value of his/her prize.

Approximate Retail Value of Lease: Drive off of $25,758 plus 24 monthly payments of $595 = Total Value for Cadillac CTS and Drive off of $24,727.50 plus 24 monthly payments of $495 = Total Value for Infiniti G35.

Prize Restrictions: Winner must maintain the car (and insurance for the car) during the 2-year lease according to the terms of the Lease Agreement. Winner will be required to return the car to the Sponsor at the end of the 2-year lease term as set forth in the Lease Agreement. Winner may have the option to purchase at the end of lease term, as set forth in the Lease Agreement.

Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of the prize not specifically stated herein are the sole responsibility of the Winner. All expenses relating to the receipt and use of Vehicle, including any travel and transportation costs associated with collecting the Vehicle, are the sole responsibility of the individual prize Winner. Any applicable tax, title, license, and/or registration fees are the sole responsibility of the Winner, as are any dealer fees, fees for preparation, fees for inspections, and/or any vehicle costs or charges specified in the Lease Agreement, including but not limited to charges for excess mileage and excessive wear and tear.

GENERAL CONDITIONS: If, for any reason, the Promotion is not capable of running as planned, including infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the operation, administration, security, fairness, integrity, or proper conduct of this Promotion, Sponsor may, in its sole discretion, void any suspect entries and: (a) cancel, suspend, or terminate the Promotion (or any portion thereof); (b) modify the Promotion or suspend the Promotion to address the impairment and then resume the Promotion in a manner that best conforms to the spirit of these Official Rules; and/or (c) award the prize from among the eligible entries received, up to the time of impairment. Entrants may not use or cause to be used automated programs or devices of any kind to submit votes in connection with the Promotion.

WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE ASSOCIATED WITH THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Neither Sponsor nor anyone acting on its behalf will enter into any communications with any entrant regarding this Promotion, except as expressly set forth in these Official Rules. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be attempting to tamper with or undermine the entry process and/or the legitimate operation of the Promotion; to violate the Official Rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person. Entrants agree that Sponsor shall own the entries, which shall not be acknowledged or returned.

RELEASE AND LIMITATIONS OF LIABILITY: BY PARTICIPATING IN THIS PROMOTION, ENTRANTS AGREE THAT SPONSOR AND ITS AFFILIATES, PARENTS, SUBSIDIARIES, FRANCHISEES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, LEGAL COUNSEL, ADVERTISING, PUBLICATIONS, PROMOTION FULFILLMENT AND MARKETING AGENCIES, WEB SITE PROVIDERS, WEB MASTERS, AND ADMINISTRATOR, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AND AGENTS (COLLECTIVELY, THE “RELEASED PARTIES”) WILL HAVE NO LIABILITY OR RESPONSIBILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF A PRIZE, ENTRY, OR PARTICIPATION IN THIS PROMOTION OR IN ANY PROMOTION RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY. THE RELEASED PARTIES ARE NOT RESPONSIBLE IF ANY PRIZE CANNOT BE AWARDED DUE TO TRAVEL CANCELLATIONS, DELAYS, OR INTERRUPTIONS DUE TO ACTS OF GOD, ACTS OF WAR, NATURAL DISASTERS, WEATHER, OR TERRORISM. BY PARTICIPATING IN THIS PROMOTION, PARTICIPANTS AGREE THAT THE RELEASED PARTIES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY INJURIES, DAMAGES, OR LOSSES OF ANY KIND (INCLUDING WITHOUT LIMITATION DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES) TO PERSONS, INCLUDING DEATH, OR TO PROPERTY ARISING OUT OF RECEIPT OR USE OF THE PRIZE OR THE PROMOTION WEBSITE OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE PROMOTION WEBSITE.

EXCEPT WHERE PROHIBITED BY LAW, WINNER GRANTS TO SPONSOR (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR), ITS PARENTS, SUBSIDIARIES, AFFILIATES, RETAILERS, DISTRIBUTORS, ADVERTISING AND PROMOTION AGENCIES, SUPPLIERS, AND THOSE ACTING PURSUANT TO ITS AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, EACH WINNER’S NAME, PORTRAIT, PICTURE, VIDEO-RECORDING (INCLUDING WITHOUT LIMITATION THE VIDEO-RECORDING OF ENTRANTS TOUCHDOWN DANCE/CELEBRATION), VOICE, LIKENESS, OPINIONS AND BIOGRAPHICAL INFORMATION (INCLUDING WITHOUT LIMITATION HOMETOWN AND STATE) FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. ENTRANTS AGREE THAT SPONSOR SHALL OWN THE ENTRIES, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED, AND THAT SPONSOR AND ITS DESIGNEES SHALL HAVE THE PERPETUAL, WORLDWIDE RIGHT TO EDIT, PUBLISH, AND USE THE ENTRIES IN ANY WAY AND IN ANY MEDIA FOR TRADE, ADVERTISING, PROMOTIONAL, AND/OR OTHER PURPOSES AS SPONSOR AND/OR ITS DESIGNEES MAY DETERMINE WITHOUT FURTHER CONSIDERATION TO ENTRANTS OR ANY THIRD PARTY.

DISPUTES: Except where prohibited by law, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Eastern District of Texas or the appropriate Texas State Court; (2) any and all claims, judgment, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorneys’ fees; (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, without giving effect to any choice of law or conflict of laws rules (whether of the State of Texas or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Texas.
